The dismissal of the Rēzekne municipal council is not legally justified, Saeima / Artikel’s lawyers warn

As has been repeatedly reported, the municipality of Rēzekne found itself in serious budgetary difficulties this year, which raised questions about the performance of its basic functions and led to public discussions about the need for the municipality to borrow 5 million euros from the Ministry of Finance to finance the stabilize the situation. its budget. After the municipality failed to meet all requirements and deadlines for the loan, it was decided that the municipal council should be dismissed.

Edvīns Danovskis, an expert at the Legal Office of the Saeima, evaluated the dismissal bill on the agenda of the Saeima and emphasized that the legal framework for the dissolution of a municipality should be sufficient, but this is not the case at the moment.

The representative of the Legal Office of Saeima concluded that if the Rēzekne Municipal Council were dismissed and its representatives turned to the Constitutional Court, there would be a high risk that the state would lose the case.

Dāvids Valters, legal advisor of the Latvian Association of Local Authorities, also agreed with these conclusions of the representative of the Legal Office of Saeima.

In any case, the bill will have to be discussed and voted on in the plenary meeting of the Saeima. From the discussions held on Wednesday and the arguments made by the legal office, it is likely that the Saeima majority could reject the bill in the vote next week.
